Berpotensi Mengancam Kemerdekaan Pers, IJTI Minta DPR Kaji Ulang Draf Revisi UU Penyiaran

Manado, VivaSulut.com – Pemerintah bersama DPR berencana merevisi Undang-Undang Nomor 32 Tahun 2002 tentang Penyiaran.

Rencana ini telah memasuki tahap penyelesaian draf revisi UU Penyiaran.

Draf revisi UU Penyiaran yang merupakan inisiasi dari DPR telah dibahas di Baleg pada 27 Maret 2024.

Ikatan Jurnalis Televisi Indonesia (IJTI) menaruh perhatian terhadap draf revisi UU Penyiaran baik dari sisi proses penyusunan maupun subtansi.

Dalam rilis ke redaksi VivaSulut.com, Ketua Umum Ikatan Jurnalis Televisi Indonesia (IJTI) Herik Kurniawan dan Sekjen, Usmar Al Marwan mengatakan, dari proses penyusunan, IJTI menyayangkan draf revisi UU Penyiaran terkesan disusun secara tidak cermat dan berpotensi mengancam kemerdekaan pers terlebih penyusunan tidak melibatkan berbagai pihak seperti organisasi profesi jurnalis atau komunitas pers.

Dalam draf revisi UU Penyiaran terdapat sejumlah pasal yang menjadi perhatian khusus bagi IJTI.

Pertama, Pasal 50 B ayat 2 huruf c yang melarang penayangan eksklusif karya jurnalistik investigasi.

IJTI memandang pasal tersebut telah menimbulkan banyak tafsir dan membingungkan, pertanyaan besarnya mengapa RUU ini melarang televisi menayangkan secara eksklusif karya jurnalistik investigasi?

“Selama karya tersebut memegang teguh kode etik jurnalistik, berdasarkan fakta dan data yang benar, dibuat secara profesional dan semata-mata untuk kepentingan publik maka tidak boleh ada yang melarang karya jurnalistik investigasi disiarkan di televisi,” ujar Kurniawan.

Lanjutnya, secara subtansi pasal pelarangan tayangan eksklusif jurnalistik investigasi di televisi bisa diartikan sebagai upaya intervensi dan pembungkaman terhadap kemerdekaan pers di tanah air.

Upaya ini tentu sebagai suatu ancaman serius bagi kehidupan pers yang tengah dibangun bersama dengan penuh rasa tanggung jawab.

Tidak hanya itu, dikhawatirkan revisi RUU Penyiaran akan menjadi alat kekuasan serta politik oleh pihak tertentu untuk mengkebiri kerja-kerja jurnalistik yang profesional dan berkualitas.

Kedua, Pasal 50 B ayat 2 huruf k, penayangan Isi Siaran dan Konten Siaran yang mengandung berita bohong, fitnah, penghinaan, dan pencemaran nama baik.

Pasal ini dinilai sangat multi tafsir terlebih yeng menyangkut penghinaan dan pencemaran nama baik.

IJTI memandang pasal yang multi tafsir dan membingungkan berpotensi menjadi alat kekuasan untuk membungkam dan mengkriminalisasikan jurnalis/pers.

“Kita sepakat bahwa sistem tata negara menggunakan demokrasi, dan pers merupakan pilar keempat dari demokrasi. Pers memiliki tanggung jawab sebagai control sosial agar proses bernegara berjalan transparan, akuntabel dan sepenuhnya memenuhi hak-hak publik,” tambah Kurniawan.

Ketiga, Pasal 8A huruf q dan Pasal 42 ayat 2 yang menyebutkan penyelesaian sengketa terkait dengan kegiatan jurnalistik Penyiaran dilakukan oleh KPI sesuai dengan ketentuan peraturan perundang-undangan.

Pasal ini harus dikaji ulang karena bersinggungan dengan UU No 40 Tahun 1999 tentang Pers yang mengamanatkan penyelesaian sengketa jurnalistik dilakukan di Dewan Pers.

IJTI juga memandang bahwa penyelesaian sengketa jurnalistik penyiaran di KPI berpotensi mengintervensi kerja-kerja jurnalistik yang profesional, mengingat KPI merupakan lembaga yang dibentuk melalui keputusan politik di DPR.

Sesuai dengan UU Pers telah jelas bahwa komunitas pers mendapat mandat untuk membuat regulasi sendiri dalam rangka mengatur kehidupan pers yang sehat, profesional dan berkualitas melalui self regulation.

Oleh karena itu setiap sengketa yang berkaitan dengan karya jurnalistik baik penyiaran, cetak, digital (online) hanya bisa diselesaikan di Dewan Pers.

Langkah ini guna memastikan bahwa kerja-kerja jurnalistik yang profesional, berkualitas dan bertanggungjawab bisa berlangsung independent serta tidak ada intervensi dari pihak manapun.

Menyikapi hal tersebut, Ikatan Jurnalis Televisi Indonesia (IJTI) menyatakan sikap sebagai berikut:

1. Menolak dan meminta agar sejumlah pasal dalam draf revisi RUU Penyiaran yang berpotensi mengancam kemerdekaan pers dicabut
2. Meminta DPR mengkaji kembali draf revisi RUU Penyiaran dengan melibatkan semua pihak termasuk organisasi jurnalis serta publik
3. Meminta kepada semua pihak untuk mengawal revisi RUU Penyiaran agar tidak menjadi alat untuk membungkam kemerdekaan pers serta kreativitas individu di berbagai platform
