Kisruh Calon Hukum Tua Warukapas, Panitia Kabupaten Terbitkan Surat Penyampaian, Praktisi Hukum: Rawan Di Gugat

Minut, VivaSulut.Com : Kontestasi Pemilihan Hukum Tua (Pilhut) Desa Warukapas di Kecamatan Dimembe Kabupaten Minahasa Utara (Minut) semakin panas pasca pengumuman hasil Verifikasi berkas para Calon.

Diketahui tiga Bakal calon Hukum Tua yakni atas nama Julian Kamagi, Aron Joseph Wagey dan Donny Jonny Lumewan berdasarkan penelitian dan verifikasi faktual yang telah dilaksanakan oleh  panitia dinyatakan lolos berkas administrasi dan sudah diumumkan Senin 5 september 2022.

Adanya dugaan Maladministrasipun mencuat, saat salah satu calon juga dinyatakan lolos berkas, sementara jika berdasarkan Perbup Minut nomor 18 tahun 2022 (18/2022) tentang Pedoman Pemilihan Hukum Tua dan Pemilihan Hukum Tua Antar waktu, justru kena aturan  karena pernah menjalani hukuman pidana.

Usut punya usut ternyata Panitia Desa tidak mengacu pada Perbup tersebut tetapi surat penyampaian dari Panitia Daerah Pemilihan Hukum Tua kepada Panitia Pilhut Desa Warukapas dengan nomor: 14/PAN-Pilhut.Minut/IX/2022  yang ditandatangani oleh Ketua Panitia Kabupaten dr.Jane Symonz yang juga adalah Asisten 1 Pemkab Minut.

PerBup Dan Surat Penyampaian

Dalam surat tersebut menjelaskan bahwa poin g dalam Perbup 18/2022 tidak tercantum dalam pasal 33 UU nomor 6 tahun 2014 tentang Desa maupun pasal 49 Peraturan Daerah nomor 3 tahun 2015 tentang Desa.

Selanjutnya, panitia daerah merujuk UU nomor 12 tahun 2011 tentang Pembentukan Peraturan Perundang-undangan, sebagaimana telah diubah beberapa kali terakhir dengan UU nomor 13 tahun 2022 tentang Perubahan Kedua Atas UU nomor 12 tahun 2011 tentang Pembentukan Peraturan Perundang-undangan.

Bahwa dalam penetapan sistem hukum positif di Indonesia menggunakan prinsip dan hirarki peraturan perundang-undangan yang mengacuh pada teori Hans Kelsen dengan menggunakan asas lex superior derogate legi inferiori atau peraturan yang lebih rendah tidak boleh bertentangan dengan peraturan yang lebih tinggi.

Olehnya, panitia daerah menilai, pasal 34 ayat (2) huruf g Perbup 18/2022 bertentangan dengan pasal 33 UU nomor 6 tahun 2014 tentang Desa maupun pasal 49 Peraturan Daerah nomor 3 tahun 2015 tentang Desa.

“Berdasarkan analisis di atas, pelaksanaan Pilhut harus berpedoman pada Peraturan Bupati nomor 18 tahun 2022 tetapi untuk ketentuan pasal 34 ayat (2) huruf g Perbup nomor 18 tahun 2022 bisa dikesampingkan dan selanjutnya mengacuh pasal 33 huruf i UU nomor 6 tahun 2014. Dalam hal ini mengesampingkan suatu peraturan perundang-undangan yang lebih rendah seperti di atas bisa dilakukan sepanjang aturan yang lebih rendah bertentangan dengan aturan yang lebih tinggi sebagaimana tercantum dalam penjelasan UU tentang hirarki dan teori Hans Kelsen,” Demikian isi  surat penyampaian Panitia Daerah Pemilihan Hukum Tua, yang dibubuhi tandatangan Jane Symons.

Bak bola liar, Penetapan Calon Tetap Hukum Tua Desa Warukapas tersebut semakin berpolemik. Panitia kecamatan menjalankan instruksi berdasarkan surat yang mereka terima dari Panitia Kabupaten.

” Saya hanya menjalankan surat penyampaian dari panitia daerah berdasarkan surat yang diajukan panitia kecamatan. Sebagai panitia kecamatan, saya ingin ada dasar hukum untuk membatalkan poin g itu dan meloloskan bakal calon . Dari kabupaten akhirnya dikirim surat balasan tersebut dan kami mengacu pada Surat penyampaian dari Kabupaten, ” Ungkap Camat Ansye Dengah yang juga adalah Ketua Panitia Kecamatan Dimembe.

Kisruh penetapan Calon yang hanya berdasarkan surat penyampaian dari Ketua Panitia Kabupaten, dikritisi praktisi hukum Rizky Hidayah.

” Seharusnya ada Juknis yang ditandatangani oleh Bupati sehingga tidak menyalahi aturan. Ini bisa jadi Maladministrasi, rawan di gugat dikarenakan Perbup tidak bisa dibatalkan hanya melalui surat penyampaian,” Tegas Hidayah.

Diketahui saat pengumuman Calon Hukum Tua Senin (5/9) sempat terjadi ketegangan pasalnya Panitia Desa tidak mengizinkan berkas administrasi untuk dibacakan.
