SAKTI Suarakan Praktek Perbudakan Kapal Perikanan di Festival HAM 2024 Bitung

Bitung, VivaSulut.com – Hari kedua Festival HAM 2024 di Kota Bitung diisi dengan diskusi dengan berbagai materi yang berkaitan dengan HAM, Selasa (30/7/2024).

Salah satu materi adalah Bisnis dan HAM di Sektor Kelautan. Diskusi ini digelar di Ruang SH Sarundajang dan dihadiri Ketua Umum Serikat Awak Kapal Perikanan Bersatu (SAKTI) Sulawesi Utara, Arnon Hiborang.

Dalam diskusi itu, Arnom mengangkat ratifikasi ILO C 188 guna memberikan perlindungan yang cukup kepada pekerja di atas kapal perikanan.

Arnom menganggap selama ini hukum nasional yang ada belum cukup mampu menjawab permasalahan-permasalahan yang dialami oleh ABK yang bersumber dari kapal asing.

Aturan hukum, kata dia, hanya sebatas perlindungan tenaga kerja Indonesia yang berprofesi sebagai pelaut yakni, Undang-undang Nomor: 39 Tahun 2004 tentang Penempatan dan Perlindungan Tenaga Kerja Indonesia di Luar Negeri.

“Secara garis besar, ini belum mengatur atau menjawab permasalahan ABK secara komprehensif hal tersebut terbukti masih banyak pekerja diatas kapal mengalami pelanggaran HAM,” kata Arnon.

Otomatis, kata dia, kebijakan yang belum berpihak kepada profesi yang paling tua di Republik Indonesia (pelaut) ini. Ia punmendorong kepada Komnas HAM agar ikut terlibat dalam hal ratifikasi konvensi ILO C 188.

“Saat ini profesi pelaut telah mengalami banyak ragam persoalan. Mulai dari perbudakan diatas kapal, ekosistem pesisir hilang akibat aktivitas pencemaran industri dan kriminalisasi nelayan yang membelah lingkungan. Sudah saatnya negara hadir lewat kebijakan yang berpihak,” katanya.

Bekerja pada sektor perikanan, lanjut Arnom, sebuah pekerjaan yang memiliki tingkat resiko dan bahaya tinggi. Persoalan yang paling banyak terjadi oleh ABK Indonesia adalah soal upah yang tidak diterima sesuai dengan standar.

“Upah yang jauh dari standar menjadi penyebab pelanggaran HAM yang sering terjadi oleh ABK Indonesia. Ditambah lagi Undang-undang yang digunakan masih bersifat umum sedangkan secara teknis belum diatur. Sehingga ini menjadi dasar kami dalam hal mendorong ratifikasi konvensi ILO C 188,” katanya.
