Kasus Dugaan Pencurian, PT CCK Laporkan Penyidik Polres Minut ke Mabes Polri

Bitung, VivaSulut.com – Kuasa Hukum PT Crown Crusher Konstruksindo (CCK), Michael Remizaldy Jacobus SH MH melaporkan penyidik Polres Minut ke Mabes Polri.

Laporan itu terpaksa dilayangkan Michael mengingat Laporan Pengaduan yang tercatat dengan Laporan Pengaduan Nomor: LP.ADUAN/240/XII/2023/SPKT/POLRES MINUT, 9 Desember 2023 tak kunjung ada perkembangan.

Padahal kata advokat muda Kota Bitung ini, laporannya telah ditangani Penyidik Unit V Tipiter dipimpin AIPDA Rivay Rumambi, namun enam bulan lebih tanpa kepastian hukum bahkan stuck pada tahapan penyelidikan.

“Padahal pada Februari 2024 pihak Penyidik sudah meminta kami untuk menambah bukti berupa Keputusan RUPS dan ahli hukum perseroan, dan kami sudah memenuhi semuanya,” kata Michael, Jumat (10/5/2024).

Direktur MRJ Law Office dan LBH Missio Justitia ini menyampaikan asal muasal leporan PT CCK, yakni laporan aduan ditujukan terhadap salah satu pemegang saham inisial SAG alias Susan, beserta ayah DK alian Djun dan adiknya CAG alias Chandra, karena mereka pada Jumat, 8 Desember 2023 kira-kira pukul 15.30 Wita mendatangi lokasi tambang PT CCK untuk menghentikan operasi, mengambil kunci ruang panel listrik dan crusher, mengambil dvr cctv dan menakut-nakuti karyawan.

Kliennya, yakni Edrick Tanaka dalam kedudukan sebagai Direktur PT CCK tidak terima perusahaannya diacak-acak sehingga Para Terlapor dilaporkan dengan dugaan melakukan pencurian dan/atau penggelapan sebagaimana diatur dalam Pasal 362 KUHPidana dan/atau Pasal 372 KUHPidana, namun sayang Polisi lambat penangananya.

“Awalnya, sebagai pelapor kami telah mengajukan alat bukti yang maksimal antara lain, tiga orang saksi yang melihat pengambilan barang-barang perusahaan berupa kunci dan dvr cctv, pemilik tokoh tempat dibelinya aset perusahaan sudah diperiksa juga, dua orang pemegang saham PT CCK yakni Edrick Tanaka dan Antonius Wijaya serta satu ahli pidana,” jelasnya.

“Bahkan kami sudah mengajukan pula bukti surat berupa Akta Pendirian perusahaan, bukti belanja barang yang diambil ditambah daftar aset perusahaan yang dibeli pada 2023,” katanya.

Ironinya, kata Kandidat doktor hukum Universitas Trisakti ini, salah satu terlapor, yakni Susan tampaknya begitu “sakti” didepan lembaga kepolisian. Terbukti dari sejumlah panggilan, ia tidak pernah hadir dan Polisi tidak dapat berbuar apa-apa.

“Saya jadi advokat sudah hampir 17 tahun, tapi baru kali ini ada tangani perkara pidana dimana terlapornya sampai lima kali panggilan namun tidak pernah hadir dan pihak Polisi diam saja. Dimana wibawa Polri kalau seperti ini,” katanya.

Selain itu, Michael juga mempertanyakan apa alasannya sehingga kasus ini tidak bisa naik sidik. Padahal dirinya bersama klien hanya butuh kepastian hukum dan jika penyelidik ragu karena antara terlapor dan pelapor ada hubungan suami isteri, maka silahkan hentikan penyelidikan.

“Saya tidak terima kalau kasus ini sulit naik sidik karena hubungan suami isteri antara pelapor dan terlapor, karena barang yang diduga dicuri atau digelapkan adalah aset perusahaan dan bukan harta bersama suami isteri. Apalagi diperusahaan ada pemegang saham lain. Jadi tidak masuk akal pakai alasan itu. Akan tetapi kalau pihak penyelidik juga takut, yah silahkan terbitkan pemberitahuan penghentian penyelidikan, supaya kami dapat kepastian hukum. Jadi jangan diulur-ulur,” jelasnya.

Menurutnya wajah penegakan hukum yang diterapkan penyidik Polres Minut dapat menurunkan kepercayaan publik kepada institusi Polri, sehingga kliennya telah memutuskan untuk mengambil langkah mengajukan laporan/pengaduan ke Mabes Polri.

“Perusahaan yang pakai pengacara saja ditangani dengan model begini apalagi masyarakat miskin yang butuh keadilan. Itulah sebab kami memutuskan Senin, (13/5/2024) menyampaikan pengaduan masyarakat ke Mabes Polri atas kinerja Penyelidik Polres Minut,” katanya.
